As per the law, it is illegal to drive a motor vehicle without a valid driving license. The Motor Vehicles Act, 1988 states that an individual who wants to drive in public areas of India should hold a driving license. The MVA, 1988 also makes it compulsory for an individual to first obtain a learning license as it acts as a temporary license giving an individual the freedom to practice driving. An individual who holds a learning license can learn to drive a vehicle under the supervision of a person who holds a valid driving license. The Jammu and Kashmir RTO functions as per the rules of the Motor Vehicles Act,1988 that makes it mandatory for an individual to obtain a learning license by following the below process.
A car insurance policy is mandatory for every vehicle registered at Jammu and Kashmir RTO as per The Motor Vehicle Act, 1988.
The J&K RTO issues a learning license to an individual on the basis of the below vehicle types.
Learning license issued for a motorcycle without gear: This type of learning license is issued for driving motor vehicles such as scooters and mopeds, without gear. Motor vehicles not exceeding an engine capacity of 50cc are also included in this license category.
Learning license issued for a light motor vehicle: This type of learning license is issued to an individual who wants to drive light motor vehicles such as a car, bike, etc.
Learning license for a commercial vehicle: This type of learning license is issued to an individual who wants to drive commercial vehicles such as lorry, truck, trailer, etc.

An application for a permanent driving license in Jammu and Kashmir can be made after 30 days or within 180 days from the date of issuance of the learning license. Hence, first, an individual will have to obtain a learning license by following either of the below application procedure.

Jammu and Kashmir duplicate learning license is issued to an individual whose original learning license is damaged, lost or stolen. Such an individual can make a written application to the RTO by giving out the reason for obtaining a duplicate LL.

Procedure to obtain a duplicate learning license in Jammu and Kashmir
An application for a duplicate learning license in Jammu and Kashmir has to be made online or offline at the RTO. The applicant will have to visit the RTO for the verification process. Once the documents are verified, the duplicate learning license is issued to the applicant. Filing a First Information Report is mandatory in case of theft of the learning license as the RTO would not issue the duplicate LL without it.
A learning license test in Jammu and Kashmir is conducted as per the rules of the Motor Vehicles Act, 1988. The test is conducted in presence of the Motor Vehicles Inspector who assesses the knowledge of traffic rules and regulations of the applicant. The applicant has to visit the RTO to give the test that will be conducted online or in written form. If the applicant passes the test, he is issued the learning license. However, on failing the test, the applicant can re-appear for the test after 7 days. The slot of the learning license test can be booked online or directly at the RTO.

What will happen If I do not make an application for a permanent driving license after obtaining the Jammu and Kashmir learning license?
Nothing will happen if you don’t make an application for a permanent DL after obtaining the J&K LL. However, ideally, an application for a permanent driving license can be made within 6 days from the date of issuance of the learning license. If the application is not made within the grace period, then the applicant will have to apply for renewal of learning license or a fresh learning license, depending on what the RTO allows.
